PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THEY CONTAIN AN AGREEMENT TO ARBITRATE AND OTHER IMPORTANT PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. BY ACCESSING OR USING THE ODYSSEUS CAREERS APPLICATION, YOU AGREE TO BE BOUND BY THESE TERMS.

ARTICLE 1 – INTRODUCTION AND ACCEPTANCE

1.1. These Terms of Service (the “Terms”) constitute a legally binding agreement between you, either individually or on behalf of an entity (“you,” “your,” or “Customer”), and Cyberquantm Technologies LLC, a Massachusetts limited liability company (“Cyberquantm,” “Company,” “we,” “our,” or “us”), governing your access to and use of Odysseus Careers, the flagship application of Cyberquantm Technologies LLC, together with all related websites, applications, APIs, dashboards, and software (collectively, the “Services”).

1.2. Odysseus Careers is a proprietary application designed, developed, and supported by Cyberquantm Technologies LLC. By creating an account, clicking “I Agree,” accessing, or otherwise using the Services, you represent that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by this reference. If you do not agree to these Terms, you must not access or use the Services.

1.3. If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case “you” and “your” refers to that entity.

ARTICLE 2 – SCOPE OF SERVICES

2.1. Odysseus Careers is Cyberquantm Technologies LLC’s flagship career-acceleration application. The Services enable users to generate, manage, and download professional application packages (including resumes, cover letters, and related artifacts), manage profile positioning, and access tiered features as described in the Odysseus Careers Product Addendum below.

2.2. The Services may be delivered through mobile applications (including iOS), web interfaces, and related APIs. Features, package allowances, and digital experience levels vary by subscription tier as set forth in the Product Addendum.

2.3. Cyberquantm reserves the right to modify, update, or discontinue features of the Services, subject to the notice provisions in these Terms.

ARTICLE 3 – ELIGIBILITY

3.1. You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.

3.2. You may not use the Services if you are located in, or a national or resident of, any country subject to a U.S. government embargo, or if you are listed on any U.S. government list of prohibited or restricted parties.

ARTICLE 4 – ACCOUNTS

4.1. To access the Services, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4.2. You may delete your account at any time through the in-application workflow or by contacting Cyberquantm. Account deletion is separate from subscription cancellation. See the Product Addendum for deletion procedures and data handling.

ARTICLE 5 – YOUR CONTENT

5.1. “Your Content” means any data, files, resumes, job descriptions, generated packages, and other materials that you upload, submit, or generate through Odysseus Careers.

5.2. As between you and Cyberquantm, you retain all right, title, and interest in and to Your Content. You grant Cyberquantm a limited license to process Your Content solely as necessary to provide the Services.

ARTICLE 6 – FEES, SUBSCRIPTIONS, AND PAYMENT

6.1. Access to certain features requires payment of subscription fees. Subscription tiers, pricing, package allowances, and feature entitlements for Odysseus Careers are set forth in the Product Addendum.

6.2. Payments for Odysseus Careers subscriptions are collected through Apple payment subscriptions. You may cancel a subscription at any time through your Apple account/subscriptions settings. Cancellation takes effect at the end of the current billing period unless otherwise stated by Apple.

6.3. Except as required by applicable law or Apple’s platform rules, Fees are non-refundable.

ARTICLE 7 – INTELLECTUAL PROPERTY

7.1. Odysseus Careers is proprietary. The application, including all software, algorithms, models, interfaces, and documentation, is designed, developed, and supported by Cyberquantm Technologies LLC. Cyberquantm retains all right, title, and interest in the Platform except for Your Content.

7.2. “Cyberquantm,” “Odysseus Careers,” and associated logos are trademarks of Cyberquantm Technologies LLC.

ARTICLE 8 – DISCLAIMERS AND LIMITATION OF LIABILITY

8.1. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERQUANTM’S TOTAL AGGREGATE LIABILITY ARISING OUT OF THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

ARTICLE 9 – TERM AND TERMINATION

9.1. You may terminate your account at any time. Upon termination, your right to access the Services ceases. Before deleting your account, you may request an export of Your Content through “Export your data” in the application while signed in. A prepared export is available for 24 hours after preparation or until account deletion, whichever comes first, as described in the Product Addendum. Account deletion removes server-side exports, so you must download any export before deleting your account. Your Content may otherwise be deleted in accordance with the Product Addendum, except where retention is required by law.

ARTICLE 10 – DISPUTE RESOLUTION

10.1. These Terms are governed by the laws of the Commonwealth of Massachusetts. Disputes will be resolved by binding individual arbitration administered by the American Arbitration Association in Massachusetts, subject to Section 17 of the Cyberquantm Technologies LLC Terms of Service, available at https://cyberquantm.com/terms-of-service, including its class-action waiver, opt-out right, and exceptions, which are incorporated by reference for non-product-specific provisions.

PRODUCT-SPECIFIC TERMS OF SERVICE ADDENDUM

Effective October 19, 2026

This Addendum supplements the Cyberquantm Technologies LLC Terms of Service for the Odysseus Careers flagship application. The existing Terms remain unchanged except as specifically clarified here. If this Addendum conflicts with the Terms about Odysseus Careers subscription tiers, package allowances, payment, account deletion, or attribution, this Addendum controls for Odysseus Careers only.

1. ABOUT ODYSSEUS CAREERS

Odysseus Careers is a proprietary application designed, developed, and supported by Cyberquantm Technologies LLC. It is the flagship application of Cyberquantm Technologies LLC.

2. FREE SUBSCRIPTION TIER

Users on the free subscription tier will have the ability to generate up to 10 limited packages per month, subject to a limited application and use of the platform.

3. PAID SUBSCRIPTION TIERS

Pro Tier. $19.99 per month or $189.99 per year. Users will have access to download 30 professional packages per month, a full set of professional features, and a less limited digital experience.

Elite Tier. $39.99 per month or $389.99 per year. Users will have access to download 90 professional packages per month, the full set of professional features, a less limited digital experience, and unlocked Executive features for their profile positioning.

4. PACKAGE ALLOWANCES AND GENERATION LIMITS

Free accounts include up to 10 limited package generations per calendar month. Pro subscriptions include up to 30 package generations per calendar month. Elite subscriptions include up to 90 package generations per calendar month.

Monthly allowances apply to both monthly and annual subscriptions. Annual subscriptions receive the applicable monthly allowance, not the entire year’s allowance at once. Allowances reset at 00:00 UTC on the first day of each calendar month. Unused generations do not roll over.

All tiers, including Elite, permit a maximum of 3 accepted generation starts within any rolling one-hour period and 10 accepted generation starts within any rolling 24-hour period. These limits apply separately from the monthly allowance.

An accepted generation temporarily reserves one monthly generation. Successful completion consumes that generation. If the job is recorded as failed, validation-failed, quality-failed or cancelled, the monthly reservation is released. An accepted start still counts toward the hourly and daily limits even if the job subsequently fails.

Requests rejected before a generation job is accepted do not count as generation starts. Retrieving the same job through an idempotent retry does not consume an additional generation.

5. ACCOUNT AND INFORMATION DELETION

In all tiers, the user can delete their account at any time and has an option to delete their information at any time, subject to the procedures and limited retention exceptions described in the Privacy Policy and this Addendum.

6. PAYMENT AND CANCELLATION

Payment collected from users who subscribe to Odysseus Careers will be processed using the Apple payment subscription system. Subscriptions can be cancelled at any time through the user’s Apple account/subscriptions settings.

7. SAVED WORK AND STANDARD RETENTION

Odysseus Careers applies the same retention schedule as Section 6 of the Odysseus Careers Product-Specific Privacy Policy Addendum. The periods below describe when Odysseus Careers data becomes eligible for removal; they are not guarantees that data will be removed on that date. Data may be removed sooner if the user deletes it or deletes the account, and may be kept longer where required by law. The following standards apply:

Aggregate or de-identified statistics that cannot reasonably identify a person may be retained longer. Production retention checks run daily. Scheduled deletion under the stated retention periods is not yet enabled. Account deletion remains available through the application.

Users can request a copy of their data through “Export your data” in the application while signed in. The export is a ZIP file containing structured JSON data and available retained files, downloadable only by the authorized account owner. A prepared export is available for 24 hours after preparation or until account deletion, whichever comes first. Account deletion removes server-side exports and the authentication identity, so users must download any export before deleting their account; copies already downloaded remain on the user’s device. Deletion from live systems may not immediately remove copies held in backups; those copies expire according to applicable backup arrangements.

8. INACTIVE ACCOUNTS

An Odysseus Careers account may become eligible for deletion after 730 consecutive days without authenticated account or application activity, subject to notice and safeguards. Cyberquantm intends to send warning emails approximately 30 days and 7 days before inactivity deletion. Signing in or using an available keep-account control resets the period. Inactivity deletion is separately controlled and is not currently enabled.

9. PERMANENT ACCOUNT DELETION

The user may request permanent account deletion through the in-app Privacy & Trust workflow. The confirmation process is designed to prevent accidental deletion. Once processed, the action is irreversible for live systems. Permanent account deletion and subscription cancellation are separate actions. If the user subscribed through Apple, the user must manage or cancel that subscription through Apple. Deletion does not create a right to a refund except where required by law or Apple’s rules.
